PLEASE READ THESE TERMS AND CONDITIONS OF MEMBERSHIP IN THE OLAPLEX PRO REWARDS PROGRAM CAREFULLY.  BY PARTICIPATING IN THIS PROGRAM, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE.  IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT PARTICIPATE IN THIS PROGRAM.


Notice About Dispute Resolution:  Any disputes relating to the Program are subject to binding arbitration per the OLAPLEX Online

OVERVIEW

What is the OLAPLEX Pro Rewards Program?

The Program provides stylists with a unique experience to engage in the OLAPLEX community with VIP treatment and exclusive perks. By shopping on pro.olaplex.com, the OLAPLEX Pro app, and at authorized distributors, eligible professional stylists can earn their way to different tier levels with exclusive perks and rewards.  Points also can be earned by participating in different on-site activities. Points can be redeemed for OLAPLEX salon swag, products, and exclusive experiences.  See details below. We 

MEMBERSHIP & ELIGIBILITY

How to join: 

You will have the option to join the Program when (a) registering for a professional account at pro.olaplex.com, (b) visiting the Program page at the same site, or (c) through your account profile.  In each case, just follow the Program prompts to sign up. 

Eligibility: 

  • The Program is available only to U.S. based individuals for their personal use only and is limited to one account per eligible individual.  A salon cannot join directly but can participate through an individual representative who has a professional stylist account at pro.olaplex.com. 
  • You must be registered as a professional stylist at pro.olaplex.com, which requires proof of your valid cosmetology license. You also must be a legal resident of the United States (including its territories) and at least 18 years old. 
  • Membership in the Program is voluntary and you may opt out at any time by contacting customer service. No purchase is necessary in order to enroll.
  • Employees of OLAPLEX, its affiliates, and of beauty-supply stores, and such employees’ family members (e.g., immediate family members residing in the same household as the employee) are not eligible to participate in the Program.
  • OLAPLEX reserves the right to verify eligibility at any time, and to exclude anyone from participating from the Program at any time in OLAPLEX’s discretion.  By joining you agree to cooperate in providing any information reasonably requested by OLAPLEX about your eligibility for, or participation in, the Program.  Failure to cooperate is grounds for exclusion from the Program. 
  • Limit one Program account per person.  Any attempt to create more than one account via multiple names, email addresses, or any other means, is grounds for removal from the Program. 
  • You are required to provide your full name and e-mail address in order to enroll. Additionally, we will also collect and store the history of your prior and future qualifying purchases of OLAPLEX products.   
  • Upon enrollment, you must create a password.  You are solely responsible for maintaining the accuracy and security of your account information, and for updating it as required. You may update your personal information through your account on the Site or by contacting OLAPLEX Customer Service at [email protected].  You are responsible for all use of your account by anyone with access to your log-in information. 

POINTS

How to earn points:

Program points can be earned by making purchases at pro.olaplex.com, the OLAPLEX Pro App, or by uploading a copy of your receipt of OLAPLEX purchases at authorized distributors in the United States (and its territories) only, and also by taking various engagement actions as advertised by OLAPLEX that may be available from time to time.  Details on each method and other important terms are set forth below.

  • Click here to view a current list of ways to earn points. These are subject to change at any time at the discretion of OLAPLEX. Certain activities may have a cap on how many times you can perform the activity to earn points.  Any such cap will be disclosed along with the description of the activity.
  • You can earn points by making a product purchase at pro.olaplex.com and on the OLAPLEX pro app.   Members will earn a set amount of points per every dollar spent via those means, as specified here provided that amounts paid for tax, shipping, handling, gift cards, or specific products identified as ineligible from time to time, do not count.   Occasionally, OLAPLEX may offer promotional days where the number of points earned may increase from the amount listed at the linked page.  For purchases via the OLAPLEX site or app to qualify for the Program, you must be enrolled in the Program, and you must purchase via the OLAPLEX site or pro app with the same name and e-mail address that is linked to your Program account;
    • In the case where products from a points-earning transaction are returned for a refund to the original payment method, points will be deducted from your rewards program account in an amount reflecting the original purchase prices for the purchased product(s), not including any amounts that were paid for tax, shipping or handling. If you already have used/redeemed points earned from a transaction and then return the products from the qualifying purchase, the amount of the refund you receive for such return may be reduced by the value of the reward(s) you claimed using points from the qualifying purchase transaction.
  • You also can earn points by making qualifying merchandise purchases from authorized U.S. distributors.  Amounts paid for tax, shipping, handling, gift cards, or specific products identified as ineligible from time to time, do not count. 
    • To receive points on such purchases, you must upload a copy of your receipt or valid proof of purchase showing itemized OLAPLEX products. The Receipt must display distributor name, address, date/time of purchase, unique identifier (such as a receipt number or barcode), an itemized list of OLAPLEX products, and amount paid for each product. The receipt must be uploaded within 60 days of purchase. 
    • To upload a copy of a receipt, log into your professional account at pro.olaplex.com and go to your customer profile. Click on the Rewards section, then click “Upload a Receipt”. Follow the instructions to upload your receipt. Receipts may take up to 72 hours to be verified.  If there is a problem with verification, OLAPLEX will attempt to contact you via the email address associated with your account to seek to resolve the situation.  
    • The current list of authorized distributors is as follows and may be updated by OLAPLEX from time.  If you are unsure if a distributor is authorized, you can contact OLAPLEX at [email protected] to verify the distributor’s status.

    • Even if you are not yet a Program member at the time of a qualifying purchase from an authorized distributor, you can still claim points if you join as a member within 60 days after the purchase and upload your receipt within that time.  
    • Returns of product are subject to the same return terms procedures described above for purchases via the OLAPLEX site or app.  
    • OLAPLEX reserves the right to determine, at its reasonable discretion, if purchase and/or return patterns appear suspicious or made in an effort to abuse the Program and to disallow points from the affected transaction(s).  OLAPLEX may consult with the applicable distributor(s) in such cases. 
  • Points have no cash value and may not be shared or combined by members.  Only the member who earned the points may receive them and later use them.  We reserve the right to monitor the number of accounts per household (or entity) and refuse, merge or close additional or duplicate accounts at any time. 
  • Purchase balances credited to your Program account will be decreased or reversed, as applicable, if part or all of the purchase is returned or cancelled or if the credit is obtained through fraudulent or other activity that violates these Program Terms as determined by OLAPLEX in its sole discretion.  The sale, barter, transfer, donation, auction or assignment of any rewards offered through the Program, other than by OLAPLEX, is expressly prohibited. Any applicable tax liabilities resulting from rewards earned or awarded under the Program are the responsibility of the Member.
  • We reserve the right to place limits on the number of purchases or activities that are eligible for the Program, the number or type of rewards you may receive in a given time period or for the duration of the Program, and/or any combination thereof.
  • It may take up to ten days for eligible purchases to post to your Program account.  
  • Purchases only count toward points after posting to your Program account, regardless when the purchase(s) occurred and even if this means the purchase counts toward a later “sales period” for purposes of determining tier status.  See the Tiers Section below for more details.  Please contact OLAPLEX Customer Service for an update on your purchase history and/or questions about your online account.  
  • If you have concerns that a purchase or other activity was not properly applied to your account, you should contact OLAPLEX Customer Service at [email protected]. You must specify your name and e-mail address linked to your Program account, the date of the Program activity, and the issue(s) you encountered.  You must contact OLAPLEX Customer Service via e-mail or telephone within sixty (60) days of the date the purchase or other Program activity took place, or no points will be credited.  We are not responsible for late notifications about purchases or other Program activities not being credited to an account.

 

Points and Reward Code Expiration:

  • Points will expire after 12 months of inactivity on your account. Inactivity is defined as a period in which a Member earns no Points or redeems no Points. 
  • Any Reward Codes issued to you (See Rewards Section Below) are subject to the expiration date, if any, that is communicated with the Reward Code.

 

TIERS

How Tier levels are assigned:

  • Tiers are determined by the dollar amount spent in a “sales period” (A “sales period” is from January 1-December 31). This includes dollars spent at olaplex.com, pro.olaplex.com, and at authorized distributors. 
  • Your tier assignment during your first sales period in the program will be determined based on your year-to-date purchases. The amount you spend on OLAPLEX purchases by the end of the sales period (December 31) will determine your tier status for the following year. Statuses will be determined on or around February 1st each year and will remain until your tier status is updated the following year. If your year-to-date purchases are greater than the previous sales period, you will be upgraded to the relevant tier and your status will remain through the following sales period.  For avoidance of doubt: (a) January purchases count toward tier status for the following year, not the period beginning on or around February 1st of the same year; and (b) Tier status is based on dollars spent during the applicable sales period, not accumulated Points. 
  • Your tier status determines the specific perks you can enjoy as a rewards member. Tiers are defined at olaplex.com/pages/pro-loyalty-program and are subject to change at the discretion of OLAPLEX.

 

REWARDS AND REDEMPTION

  • Points may be used for the rewards available at the time members wish to use the points. They may not be exchanged for cash or used for any other purpose.  
  • Available rewards are listed at olaplex.com/pages/pro-loyalty-program. A reward is active once the member has enough points to redeem the reward. To redeem a reward, add the reward to your cart and the associated amount of points will be deducted from your points balance. 
  • Points may only be redeemed for available reward items offered at that time at olaplex.com/pages/pro-loyalty-program.   Points may not be used for any other purpose unless expressly authorized by OLAPLEX. 
  • Rewards cannot be exchanged or returned for other rewards, another product, a discount on purchases or a monetary refund except when expressly permitted by OLAPLEX in its sole discretion.
  • OLAPLEX is not responsible for rewards lost or redeemed due to fraudulent activity by you or any third party. OLAPLEX is not responsible for rewards that are lost, stolen or otherwise destroyed.

 

COMMUNICATIONS

  • As a Program member, you may receive marketing emails from OLAPLEX to inform you of new engagement activities, new available rewards, exclusive events, membership perks, and more. You may also receive operational emails with information regarding your points balance, points earned, and points redeemed.
  • You may opt-out of receiving Program marketing e-mails at any time by following the instructions provided in the email or as otherwise provided in the OLAPLEX Privacy Policy, but operational e-mails will still be sent to you as they relate to your membership in the Program.  Examples of these include, but are not limited to, a redemption confirmation e-mail, a profile update e-mail, or other communications that relate to your account.  If you terminate your Program membership, you will no longer receive Program-related communications.

 

Termination and Modification

  

  • The Program and its benefits are offered at OLAPLEX’s sole discretion.  OLAPLEX may, in its discretion, cancel, modify, restrict or terminate these Program Terms and/or the Program or any aspect or feature of the Program at any time, even though such changes may affect the value of rewards or benefits already accumulated or earned.   When we do, we will post the updates here.   Continued participation after the effective date of any changes constitutes acceptance of the updated Program Terms.
  • OLAPLEX reserves the right to, at any time, in its sole discretion to: (1) exclude you from participation in the Program; (2) discontinue your participation in the Program; and/or (3) suspend or audit your membership account for any amount of time without prior notice.  Any suspected abuse of the Program, failure to follow any Program Terms, illegal activity, fraud, misrepresentation or other conduct inconsistent with these Program Terms and/or detrimental to us or our interests, including without limitation, any suspected illegal, fraudulent other unauthorized use of any Program rewards, cards, credits, vouchers, coupons and/or certificates, may result in the revocation of your membership and make you ineligible for further participation in the Program.  If your membership is revoked, any rewards or benefits in your account will automatically expire and your access to the Program and features will automatically terminate. If we suspect illegal activity, fraud, misrepresentation, abuse or violation of these Program Terms, we also reserve the right to take appropriate legal action, in our sole discretion.
  • If you decide you no longer want to be a part of the Program, you may terminate your membership at any time by contacting OLAPLEX Customer Service at [email protected].

 

Disclaimer of Warranties; Limitation of Liability

  • NEITHER OLAPLEX NOR ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, IN CONNECTION WITH THESE TERMS OR THE PROGRAM OR ANY OF THE REWARDS OR BENEFITS ASSOCIATED WITH THE PROGRAM INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT TO THE EXTENT SUCH REPRESENTATIONS AND WARRANTIES ARE NOT LEGALLY EXCLUDABLE.

 

  • YOU AGREE THAT NEITHER OLAPLEX NOR ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS WILL BE RESPONSIBLE OR LIABLE IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE) FOR ANY (A) INTERRUPTION OF BUSINESS; (B) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO THE PROGRAM; (C) DATA NON-DELIVERY, LOSS, THEFT, MISDELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; (D) LOSS OR DAMAGES OF ANY SORT INCURRED AS A RESULT OF DEALINGS WITH OR THE PRESENCE OF THIRD PARTY LINKS ON THE SITE OR USE OF ANY REWARD OR BENEFIT OF THE PROGRAM; (E) COMPUTER VIRUSES, SYSTEM FAILURES OR MALFUNCTIONS WHICH MAY OCCUR IN CONNECTION WITH YOUR USE OF THE SITE, INCLUDING DURING HYPERLINK TO OR FROM THIRD PARTY WEBSITES; (F) ANY INACCURACIES OR OMISSIONS IN PROGRAM CONTENT; OR (G) EVENTS BEYOND OUR REASONABLE CONTROL. WE MAKE NO REPRESENTATIONS OR WARRANTIES THAT DEFECTS OR ERRORS WILL BE CORRECTED.

 

  • FURTHER AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW NEITHER OLAPLEX NOR ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) RELATED TO THE PROGRAM OR AND YOUR PARTICIPATION THEREIN, WHETHER IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE), EVEN IF OLAPLEX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND IN NO EVENT SHALL OUR MAXIMUM AGGREGATE LIABILITY FOR SUCH CLAIMS EXCEED ONE HUNDRED DOLLARS ($100.00).  For New Jersey Residents, nothing herein restricts the ability to recover damages, costs or attorneys’ fees where mandated by statute.

 

  • YOU AGREE THAT NO CLAIMS OR ACTION IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE) ARISING OUT OF, OR RELATED TO, YOUR PARTICIPATION IN THE PROGRAM, USE OF ANY REWARDS OR OTHER BENEFIT OR THESE PROGRAM TERMS MAY BE BROUGHT BY YOU MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION RELATING TO SUCH CLAIM OR ACTION AROSE. IF YOU ARE DISSATISFIED WITH THE PROGRAM, TERMINATION OF YOUR MEMBERSHIP IN THE PROGRAM IS YOUR SOLE REMEDY. WE HAVE NO OTHER OBLIGATION, LIABILITY, OR RESPONSIBILITY TO YOU.

 

Indemnification

You agree to defend, indemnify and hold OLAPLEX, its parent companies, subsidiaries, affiliates, partners, licensors, officers, directors, employees, and agents harmless for any loss, damages or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand resulting from your participation in the Program in violation of any law, rule, regulation or these Program Terms.

 

PRIVACY

The personal information collected from you in connection with the Program, including but not limited to purchases made in connection with your Program membership, will be used and disclosed by us in accordance with the OLAPLEX Privacy Policy.
